Barbara T Hoffman is a preeminent international art and cultural heritage with decades in the field as one of its early pioneers and at the forefront of all significant legal developments. Hoffman’s practice is focused on primarily on artists, cultural institutions to whom she provides transactional, litigation and alternative dispute resolution counsel. Her well known , out of the box thinking , acknowledged quick wit and mind and passion for her areas of expertise have provided a roster of preeminent clients and involvement in fascinating projects focused including the creation of artist foundations, the creation of friends of organizations, including the first for an African museum, involvement with the first major project focusing on visual artist’s estates and foundations, projects focused on sustainability and traditional knowledge, the protection of underwater cultural heritage and international projects involving the United Nations and international efforts to preserve, cultural heritage, defend against cultural crimes and prevent illicit traffic.
Hoffman has litigated precedent setting cases in the area of copyright law on behalf of artists including Ringgold v Bet which established visual art in film on a parity with music and AFP v Morel which resulted in a verdict of over one million dollars against Agence France Presse and Getty Images for photo journalist Daniel Morel and successfully settled several cases involving the unauthorized use of artists’ and artist estates in film.
Hoffman was selected to best lawyers in art law and copyright law from 2010 and super lawyers from 2010 in copyright and copyright litigation. She received a BA cum laude, Brown University, and a JD from the Columbia Law School, Harlan Fisk Scholar. She also holds a certificate in advanced mediation from Harvard Law School and has been mediator for years for the American Film Market and the World Intellectual Property Organization.
